GENERAL TERMS AND CONDITIONS:

These Terms and Conditions govern your use of the ultimats.com website for placing orders for our products online and your relationship with ultimats.com (Ultimate, we or us). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not register for or use the ultimats.com Site. Please note that to use any of the services provided on the ultimats.com website, you are required to register as an authorised user on the site.

REGISTRATION:
Customer registration is mandatory during the course of online order placement.
ONLINE ORDER PLACEMENT:

You may place your orders online under our two ordering sections:
a. Online Mat Shop; and
b. Design A Mat
The Online Mat Shop offers you our presized mat products under various product categories and designs. It also offers you special offers and promotions on our products existing from time to time. Goods offered on promotion may also be bought at normal rates, if you so prefer.
The Design A Mat is a unique yet powerful software tool that empowers you to custom-design and order your own mat online, within certain design limitations as mentioned under our Order Execution Policy. Certain fast-selling premade designs are already available under our Online Mat Shop section that you might choose to custom-design. Custom-design costs are pre-programmed in the system and could be significantly more than the price of a standard premade mat available for sale under the Online Mat Shop section. You are advised to properly check this section before you proceed with your order.

ORDER ACKNOWLEDGEMENT:

After you place an online order, an order acknowledgement number will be generated and intimated to you. Generation of an order acknowledgement does not constitute our acceptance of the same, and will be subject to our Order Execution Policy.

PRODUCT PRICES:

Product prices appear next to each product in our Online Mat Shop section, in your preferred currency. In case a currency other than Indian Rupees is selected, prices are converted from the original value of the products in Indian Rupees at the inter-bank conversion rate fed in our program, which is updated from time to time. Hence prices in a currency other than Indian Rupees appear only for your convenience, and are only indicative. It will be our constant endeavour to regularly update these prices. You shall be billed in Indian Rupees during check-out. Your credit-card company will charge you in your local currency at their conversion rate, which is outside our scope. In our Design A Mat section, once you complete your design, please enter the desired quantity, and you will be updated with the price of the product being ordered. Delivery within India is free, but is chargeable for deliveries outside India (please refer to our Delivery Policy for further details).

 

PAYMENT TERMS:

Payments are due at the time of online purchase. Payments may be made either through credit card or cheque in case of sales within India, and only through credit card in case of sales outside India. In case of payments made by cheque, orders will not be dispatched until receipt of clear funds in our account.

ORDER EXECUTION POLICY:

A. Online Mat Shop Section Purchases:
All products ordered through our Online Mat Shop will be executed normally within 10 days of receipt of funds into our account. An order dispatch intimation will be generated and sent to you by email. You may anytime check the order status from the ?Order Status? link on our homepage through the transaction reference number provided to you when you placed your order. Acceptable manufacturing size tolerance is +/- 3%.

B. Design A Mat Section Purchases:
All products ordered through this section will be subject to a maximum of 8 colors per design, owing to equipment-related technical limitations. In case of uploaded images, the same shall be converted to pixels in a maximum use of 8 colors per entire design. Similar colors will be substituted/clubbed to close-matching colors in order to best maintain the overall theme of the ordered design. Actual colors may be different than what appear on your screen at the time of order placement, owing to different monitor settings. Manufacturing size tolerance will be within +/- 3%. In case execution of a design is not technically possible to execute, or is immoral or graphic in content, you will be intimated of our refusal/rejection of the same through email. We shall within 7 days thereafter advise the payment gateway provider to reverse your credit card transaction or we shall return your cheque payment (as the case maybe). All products ordered through this Section will be executed normally within 15 days of receipt of funds into our account. An order dispatch intimation will be generated and sent to you by email. You may anytime check the order status from the ?Order Status? link on our homepage through the transaction reference number provided to you when you placed your order. Acceptable manufacturing size tolerance is +/- 3%.

DAMAGED/MISSING GOODS SHIPMENTS:

All goods shipped are insured. If items are received in a damaged condition and/or are missing from your order, recheck the contents against the enclosed packing slip. If a shortage has actually occurred, you must obtain a damaged/short-delivery acknowledgement from the carrier immediately, or refuse delivery. Call Ultimate at +91.11.29217749 or email at info@ultimats.com within 24 hours in order to receive proper credit. Please keep the original shipping box with packing materials and merchandise for insurance company?s inspection. Ultimate will arrange for this inspection to claim for damages and proper credit. In case you fail to obtain the relevant damaged/short-delivery acknowledgement from the carrier, the Insurance Company may reject your claim, and Ultimate will bear no responsibility in such case.

RETURNED-GOODS POLICY:

Goods once sold will not be returned, unless there is a manufacturing defect in the same, and the same can be proved to us prior to the return. All returns must be authorized by our customer service department and you will be advised a Return Authorization Number. This must be done in advance in order for you to receive proper credit. Any package shipped to Ultimate without authorization and not bearing the Return Authorization Number will be refused upon arrival. Ultimate will only issue credit on merchandise that is in the original unsoiled and unused condition. Any product that has been used or damaged will not be accepted for return, credit or cash refund, but will be destroyed upon arrival. Returned goods must be sent to us with freight costs prepaid using Indian Postal Department only (in case of returns within India), which will also be refunded to you within 10 days of receipt by us in case the goods are authorized for a full refund. Difference in actual mat colors over what is ordered could arise owing to your monitor settings and is not considered a manufacturing defect. Design execution limitations listed under Order Execution Policy will not qualify as being a manufacturing defect. For returns outside India authorized by us, we shall instruct you either to ship the goods back to us using the cheapest mode available, or dispose-off the same in any other manner as instructed by us.

PRIVACY POLICY:

This policy describes the ways we collect, store, use and protect your personal information. You accept this policy when you register with us.

A. How we collect information about you
When you proceed with an online purchase transaction on our website, we collect your IP address and standard web log information, such as your browser type and the pages you accessed on our website. We also obtain the following information from you and register you as our customer:
- Contact information - your name, shipping address, phone, email, and other similar information
- Whether you wish to receive our regular product updates/newsletter
When you are making an online purchase, we collect information about your account transactions and we may collect information about your computer or other access device for fraud prevention purposes. Finally, we may collect additional information from or about you in other ways not specifically described here. For example, we may collect information related to your contact with our customer support team or store results when you respond to a survey.

B. How we protect and store personal information
Throughout this policy, we use the term "personal information" to describe information that can be associated with a specific person and can be used to identify that person. We do not consider personal information to include information that has been anonymized so that it does not identify a specific user.
We store and process your personal information on our computers in India, and we protect it by maintaining physical, electronic and procedural safeguards. We enforce physical access controls to our buildings and files, and we authorize access to personal information only for those employees who require it to fulfill their job responsibilities.

C. How we use the personal information we collect
Our primary purpose in collecting personal information is to enable us to ship the ordered goods to you. Other purposes could be any or all of the following:
a. provide the services and customer support you request;
b. process transactions and send notices about your transactions prevent potentially prohibited or illegal activities, and enforce our User Agreement; c. send you targeted marketing, service update notices, and promotional offers based on your communication preferences; d. compare information for accuracy and verify it with third parties.

D. Do we share personal information with any Third Party:
To process your payments, we need to share some of your personal information with the Bank through whom our payment will be received. Regardless, we will not disclose your credit card number or bank account number to anyone, except with your express permission or if we are required to do so to comply with a subpoena or other legal process. We do not share your personal information with any other Third Party whatsoever.

E. How you can access or change your personal information
You can review your personal information and make any necessary changes, at any time by logging in to your account and changing your preferences in the Profile page of the "My Account" tab.
F. How you can contact us about privacy questions

DELIVERY POLICY:
An invoice will accompany each order shipped.

A. Deliveries Within India:
We employ the services of the Indian Postal Department to deliver goods within India. Proper and complete postal address with PIN code is a must in order for the Indian Postal Department to deliver the goods in India. Delivery anywhere within India is free of cost.

B. Deliveries Outside India:
We employ the services of DHL to deliver goods outside India. Proper and complete postal address with ZIP code and telephone number is a must in order for DHL to deliver the goods outside India. A list of countries to which DHL will deliver your order is available in the country pull-down menu. This ensures that in case your preferred country of delivery does not appear in the pull-down list, your order will not be proceeded-with. Shipping costs are chargeable and depend on the weight calculation we have linked to each product ordered, and the zone in which your country falls. CANCELLATION AND REFUND POLICY:

Ordered goods may be cancelled by sending us a cancellation request by email at info@ultimats.com or placing a call on us at +91.11.29217749 citing the order reference number subject further to the following:
a. In case of goods ordered through our Online Mat Shop Section: Within a maximum period of 3 days from date of order, provided however, that the goods have not been dispatched by us.
b. In case of goods ordered through our Design A Mat Section: Within a maximum period of 3 days from date of order, provided however, that the order processing has not commenced at our end.

If your cancellation is within the above listed parameters, you will be provided an order cancellation number and we shall within 7 days thereafter advise the payment gateway provider to reverse your credit card transaction or we shall return your cheque payment (as the case maybe) in its entirety. Refund of your payment is not possible in any other case (except in case of a manufacturing defect in the goods as defned in our Returned Goods Policy) whatsoever, and you have no right to approach your bank/credit card company for a reversal of the charge earlier made to your account.

The ultimats.com website is provided by Ultimate without any warranties or guarantees. You must bear the risks associated with the use of the Internet. Ultimate will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the ultimats.com Webste. If Ultimate is informed of any inaccuracies in the material on the Site we will attempt to correct the inaccuracies as soon as we reasonably can. In particular, we disclaim all liabilities in connection with the following:
- incompatibility of the ultimats.com Website with any of your equipment, software or telecommunications links
- technical problems including errors or interruptions of the ultimats.com Website
- unsuitability, unreliability or inaccuracy of the Ultimats.com Website
- inadequacy of the Ultimats.com Website to meet your requirements
To the full extent allowed by applicable law, you agree that we will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Ultimats.com Website.

JURISDICTION AND CHOICE OF LAW:

This agreement shall be construed and interpreted in accordance with the laws of the Republic of India, without regard to conflict of laws, and the courts of New Delhi. New Delhi shall have exclusive jurisdiction in any controversy relating to or arising out of this agreement. In case of arbitration, venue for arbitration shall be New Delhi, India.
